Marriage is a legal contract
between two members of society. It is a relation between male and female.
Marriage is one of the basic fundamental relation of family. Male and female
needs each other in terms of sex and other social behaviors. It is
scientifically proved that opposite sex attracts each other. The marriage is
done in different societies in different ways. Customs, cultures and religions
differentiate the practices of marriage in different region of world.
When husband and wife do not want
to live together then there is a provision of separation which is called
divorce. Although divorce is not supposed to be good in many regions and societies
of world but it exits legally as it resolve the conflict between the husband
and wife. Anyone has right to live his her life according to their ways. In
modern era both members have right to take decision for separation. It varies
from society to society that which member has more power and right on divorce
but in western and Islamic law both has same rights.
Divorce has many consequences but
it directly affects the children. Children lives evolve around the parents and
only parents are their role models but when parents decide to go for separation
then one question always raises and that is only the custody of child, either
child live with his/her mother or with father. Who will look after better? In
general cases mother always requests that she could do better look after her
child, but it needs investigation after occurring of divorce.
Here are some examples which
clearly describes and solves the issues of child custody. It totally depends on
the age of children and the income source of the parents. Investigation team
will thoroughly investigate about the situation of family then they would
decide about the custody of child. For example there is a family consists of 3
members, husband, wife and one child. Husband and wife decide to go for
separation and their child is about one year old then after divorce the custody
of child will b given to mother because she looks after one year baby better
than his/her father. The basic needs of child may be provided by mother like
breast feeding, foods, clothing etc rather than father. In this case it is easy
to solve the child custody issue and it does not require further investigation.
Now take a look to another example where the family consists of three member
husband, wife and their 9 years old child. In this case it will be investigated
after divorce of parents who will look after better of their child. In the age
of 9 years the girl or boy needs better education and health. It will be
investigated that who is earning money. If mother has source of income and she
easily can take responsibility then custody of child will be given to her and
if father is earning money better than mother then custody of child would be
given to father. If both are doing job and willing to take responsibilities
than it is the responsibility of parents to look after their child together.
The investigation regarding the custody
o child is very easy and also complicated. It requires thoroughly investigation
of both husband and wife (Parents) and also the age of child. Many societies
have different laws and customs but the law of nature tells us that if child is
under the age of 5 years then its custody must be given to his/her mother and
if child age is between 5 to 12 years then its custody should be given to
his/her father or mother according to their source of income, and if child is
above the age of 12 years then it depends on him/her whether he/she feels
comforts with mother or father.
